1. Scope of Services.
Highmark Outdoors LLC (“Contractor”) provides routine residential lawn maintenance services including mowing, trimming, edging, and blowing of hard surfaces within agreed service areas. Additional residential services (including cleanups, mulching, trimming, debris removal, or enhancements) may be performed upon request or as agreed and will be billed separately unless otherwise stated in writing.
2. Service Schedule.
Services are performed on a weekly basis at residential properties on a designated service day. Service days may shift due to weather, holidays, or operational needs. Contractor will make reasonable efforts to maintain consistency.
3. Pricing & Payment Terms
- Services are billed monthly in advance unless otherwise agreed.
- Payment is due within 7 days of invoice date.
- Late payments may incur 1.5% per month (18% annually) or $25 minimum, whichever is greater.
- Services may be suspended if the account is more than 14 days past due.
4. Weather Policy.
Weather delays will be rescheduled to the next available service day. Extended delays may require schedule or service adjustments based on lawn conditions.
5. Property Conditions.
Client agrees to keep residential service areas clear of debris, pet waste, toys, furniture, and obstacles, and to mark all hidden hazards (e.g., sprinkler heads, wiring, drainage). Contractor is not responsible for damage to unmarked or concealed items.
6. Access to Property.
Clients must provide access to all residential service areas, including unlocking gates and securing pets. If access is unavailable, service may be skipped and may still be billed.
7. Equipment & Materials.
Contractor will provide all standard equipment required to perform residential lawn care services. Materials or additional services will be quoted and billed separately.
8. Damage & Liability.
Contractor will use reasonable care while performing services. Any claims must be reported within 48 hours of service. Liability is limited to the cost of repair or the value of the service provided.
9. Pricing Adjustments.
Pricing may be adjusted with 30 days’ written notice due to changes in property condition, scope, labor, or fuel costs.
10. Service Skips & Weekly Cancellations.
Clients may request to skip up to two (2) scheduled service visits per season without penalty, provided notice is given at least 24 hours prior to the scheduled service date. Additional skipped services beyond this allowance may be billed at the regular service rate to maintain route efficiency and scheduling consistency. Services that cannot be completed due to residential property conditions (including but not limited to inaccessible areas, pet waste, locked gates, or obstructions) may be considered a skipped visit and may still be billed.
11. Service Cancellation (Ongoing Service).
Clients may cancel ongoing residential lawn service at any time with a minimum of 7 days’ written notice prior to the next scheduled service. Failure to provide proper notice may result in charges for the upcoming scheduled service.
12. Agreement Termination.
Either party may terminate this agreement with 14 days’ written notice. Contractor reserves the right to terminate services immediately in cases of:
- Non-payment
- Unsafe working conditions
- Repeated service interference
13. Service Issues.
Client must report any service concerns within 24–48 hours. Contractor will make reasonable efforts to resolve issues in a timely manner.
14. Seasonal Growth Conditions.
Service frequency or scope may be adjusted during periods of rapid or limited growth due to weather conditions.
15. Pre-Approved Additional Work.
Contractor may perform minor additional work without prior approval if reasonably necessary for residential property upkeep, up to $100 per visit. Amounts exceeding this require client approval.
16. Subcontractors.
Contractor may use qualified subcontractors to perform services and remain responsible for all work completed. Client agrees not to directly hire or solicit Contractor’s subcontractors during the agreement and for 12 months following termination without written consent.
17. Independent Contractor.
Contractor is an independent business and not an employee of the Client.
18. Insurance.
Contractor maintains general liability insurance. Proof may be provided upon request. Coverage applies only to services performed under this agreement. Contractor is not responsible for pre-existing conditions, normal wear and tear, or unmarked hazards.
